Terms of Use “AI Assist”

1. Enabling AI Assist

When using the Tool, the Customer has the option to enable “AI Assist” (“AI Assist”), an AI-based tool that provides access to AI features optimized for product managers. By enabling AI Assist, the Customer, in addition to the other ToS, agrees to the terms outlined in this section. If the Customer no longer wishes to use AI Assist or disagrees with these terms, the Customer may disable AI Assist at any time.

2. Use of AI Assist; Input and Output

When using AI Assist, the Customer (or its users) may provide Content to be processed by AI Assist (“Input”) and receive output generated by AI Assist based on the Input (“Output”). For the purposes of this Agreement, both Input and Output are classified as “Customer Data”. The Customer is solely responsible for the creation, development, content, operation, maintenance, use, and dissemination of all Customer Data. The Customer is solely responsible for all Input and warrants that it has all rights, licenses, and permissions required to provide Input to AI Assist. The Customer is also solely responsible for all use of the Output and for evaluating the Output for accuracy and appropriateness for its use case, including utilizing human review as appropriate.

3. Sharing of Customer Data

The Customer acknowledges that certain elements of AI Assist are powered by OpenAI, LLC (“OpenAI”), a third-party AI service provider. The Customer acknowledges that by using AI Assist, Customer Data will automatically be shared with OpenAI to facilitate the provision of AI Assist. Data sharing with OpenAI is governed by agreements and a data processing agreement, designed to ensure the privacy and security of Customer Data. Nonetheless, airfocus explicitly advises the Customer (and its users) to avoid inputting any personal data, confidential, or other sensitive information when using AI Assist, given that the utilization of emerging technologies such as artificial intelligence inherently carries the general risk of unforeseen privacy implications.

4. Compliance and Prohibited Uses

The Customer ensures that the Input, access to, and use of AI Assist and Output will not (i) violate any applicable laws or regulations or technical documentation; (ii) violate these ToS, the Agreement, or any content and use policies airfocus may implement from time to time; or (iii) infringe upon, violate, or misappropriate any of airfocus's rights or the rights of any third party. Additionally, the Customer shall not use AI Assist in a manner that violates any OpenAI policy, including, but not limited to the Sharing & Publication Policy and Usage Policies.

5. Disclaimer of Warranties

airfocus does not make any warranties regarding the results that may be obtained from the use of AI Assist or the accuracy of any information obtained through AI Assist. The Customer acknowledges that due to the nature of AI Assist and artificial intelligence generally, Output may not be unique and other users may receive similar content from airfocus's Services.

6. Model Improvement

The Customer acknowledges that artificial intelligence and machine learning models can improve over time to better address specific use cases. airfocus does not permit OpenAI to use Customer Data to improve or train their AI models and does not use Customer Data to improve or train AI Assist without the Customer’s permission to do so.
